By using OwnLife, you agree to these terms. If you do not agree, please do not use the app.
Agreement and eligibility
These terms are a contract between you and OwnLife Analytics Ltd, 24 Westminster Road, Poole, BH13 6JN, UK ("we", "us"). They cover your use of the OwnLife mobile app and related services (the "app"). Our Privacy Policy explains how we handle your data and forms part of how the app works.
You must be at least 18 years old to use OwnLife. By creating an account, you confirm that you are 18 or over and that the information you give us is accurate.
The service
OwnLife helps you understand your own performance profile and personal routines. You log information about habits such as sleep, food and drink, and movement, and rate your focus, energy and performance. The app then shows you patterns and suggestions based on your data.
Your account. You are responsible for keeping your login details secure and for activity under your account. Tell us promptly at support@ownlifeanalytics.com if you think someone else has accessed it. Keep one account per person.
Google Health API (optional). You can choose to connect OwnLife to the Google Health API so the app can read your sleep, activity and heart rate data. This is optional and OwnLife works without it. We access this data only with your permission, and you can disconnect at any time in the app or in your Google Account settings. How we use this data is set out in our Privacy Policy.
Changes to the app. We may improve, add or remove features. If we make a change that significantly reduces what the app does for you, we will tell you in advance where we reasonably can.
Your data
Your data belongs to you. You keep all rights in the information you enter and the data you connect. You give us a limited licence to store and process it for one purpose: to provide the app to you, including calculating your performance profile and insights.
We never share your personal data with third parties, never sell it, and never use it for advertising. Full details, including how we handle Google data under the Limited Use requirements and how to access or delete your data, are in our Privacy Policy. If these terms and the Privacy Policy conflict on how we treat your personal data, the Privacy Policy applies.
You can delete your data or your account at any time, as described in the Privacy Policy.
Not medical advice
OwnLife is not a medical device. It does not diagnose, treat, cure or prevent any condition, and it does not replace professional medical advice. Its insights and suggestions are general and based on the information you provide, so they are for personal understanding only.
Speak to a qualified healthcare professional before making significant changes to your diet, sleep, exercise or medication, and about any health concern. If you think you may have a medical emergency, contact your local emergency services straight away. Do not rely on the app for urgent or medical decisions.
Acceptable use
Please use OwnLife fairly and lawfully. You agree not to:
Use the app for any unlawful purpose or in breach of these terms.
Share your account or access another person's account or data.
Attempt to break, bypass or probe the app's security, or interfere with how it works.
Copy, reverse engineer, decompile or resell the app, except where the law allows it.
Use bots, scrapers or automated tools to access the app, or upload malicious code.
Provide false information in a way that misleads us or others.
We may investigate suspected breaches and take action under the "Suspension and termination" section below.
Our intellectual property
The app, including its design, software, text, graphics, branding and the way we calculate and present insights, belongs to OwnLife Analytics Ltd or its licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own personal use under these terms. No other rights are given.
Your data stays yours (see "Your data" above). If you send us feedback or ideas about the app, we may use them to improve it without owing you anything, and without using your personal data for any other purpose.
Fees, suspension and termination
Fees. OwnLife is free to download and use. Your mobile network or the app store may charge for data or downloads, and those charges are yours.
You can stop at any time. You can delete your account in the app or by emailing support@ownlifeanalytics.com. We will then delete your data as set out in the Privacy Policy.
Suspension and termination. We may suspend or end your access if you seriously or repeatedly breach these terms, if we must do so by law, or if continuing would put the security of the app or other users at risk. Where reasonable, we will tell you why and give you a chance to fix the problem first. We may also stop providing the app altogether; if we do, we will give you reasonable notice and a chance to download or delete your data.
Warranties and liability
We provide the app with reasonable care and skill. We cannot promise it will always be available, error-free or uninterrupted, or that its insights will be accurate for you, because they depend on the information you and your connected services provide.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot legally be limited. If you are a consumer, these terms do not affect your statutory rights.
Subject to that, we are not liable for losses that were not reasonably foreseeable, for loss of business, profit or opportunity (the app is for personal use only), or for decisions you make relying on the app's insights instead of professional advice. Our total liability to you for anything arising from the app is limited to the greater of the amount you paid us in the last 12 months and £100.
General
Changes to these terms. We may update these terms, for example to reflect changes to the app or the law. If a change is significant, we will tell you in the app or by email before it takes effect. If you keep using OwnLife after that, you accept the updated terms. If you do not, you can stop using the app and delete your account.
Governing law. These terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, but if you are a consumer living elsewhere in the UK or in the EU, you keep any right to bring a claim in your local courts and to rely on your local consumer protections.
Other terms. If part of these terms is found unenforceable, the rest still applies. If we do not enforce a right straight away, we have not given it up. You may not transfer your rights under these terms without our consent. These terms and the Privacy Policy are the whole agreement between us about the app.
